Elena Kagan story and profile in the N.Y. Times

Posted by on May 10, 2010

Am I shallow for wondering why there’s no mention of Kagan’s romantic life in her profile? It was a big surprise to me that if Kagan’s confirmed, there will be 6 Catholics and 3 Jewish justices – I always thought of the Supreme Court as a WASP bastion. I’m thinking that there will be only Harvard or Yale Law graduates on the bench if she’s confirmed because the confirmation hearings can be so contentious. If a nominee isn’t from the right school, it will make it easier for the opposing political party to make a point that the nominee isn’t qualified.
